What do I need to know if the DACA program ends?

There are some reports that President Trump may end the Deferred Action for Childhood Arrivals (DACA) program soon. At this time, we do not know when or if the DACA program will be terminated or what the end of the program may look like. For example, will those with DACA continue to be protected from deportation and able to use their work permits until they expire? Or will DACA approvals and work permits be revoked? While the DACA program remains in effect at this time, below are some things to keep in mind should the program end.

  1. Work Permits /Employment Authorization Documents (EADs)
    • Generally, work permits are valid until they expire or if the government demands they be returned.  
    • If the DACA program ends but you are allowed to keep your work permit, you have the right to work legally until your work permit’s expiration date.
    • Even if the DACA program ends, you have no obligation to inform your employer that DACA has ended. Your employer does not have the right to ask you whether you are a DACA recipient or how you got your work permit.
    • Your employer does not have the right to fire you, put you on leave, or change your work status until after your work permit has expired. If your expiration date is nearing, your employer may ask you for an updated work permit but cannot take any action against you until after it is expired.
  2. Social Security Number (SSN)
    • You social security number is valid even if your DACA and work permit is expired.
    • You can use your SSN for education, banking, or other purposes.
    • Your SSN contains a condition on it that it requires a valid work permit to use it for employment purposes.

DACA PROGRAM이 종료된다면 내가 알아야 할 것은 무엇인가?

트럼프 대통령이 청소년 추방유예 프로그램 (DACA)을 곧 종료할 수도 있을 거라는 소식이 전해지고 있습니다. 지금 현재로서는 DACA 프로그램이 언제 종료될 지 또한 어떤 형태로 종료가 될지 아무도 알 수 없습니다. 예를 들어 현 DACA 수혜자들이  강제추방으로부터 보호를 받고 노동허가서를 만료일까지 사용할 수 있을지 아니면 승인된 DACA와 노동허가서가 철회될 지 지금으로서는 아무것도 예측할 수 없습니다. 다음은 DACA 프로그램이 아직 효력을 유지하는 현재의 시점에서, 다카가 종료될 경우를 생각해서 염두에 두어야 할 사항들입니다. 

  1. 노동 허가서 (Work Permits)
    • 노동 허가서 (EAD)는 일반적으로 만료되거나 정부에서 반환을 요구하기 전까지 유효합니다. 정부로부터 반환 요구를 받지 않는 한 아래와 같은 사항이 적용되어야만 합니다.
    • DACA프로그램이 종료 되더라도 노동허가서를 유지할 수 있다록 허용된다면 귀하는 허가서의 종료일까지 합법적으로 일을 할 수 있는 권리가 있습니다.
    • DACA 프로그램이 종료 되더라도, 고용주에게 DACA 프로그램이 종료되었음을 알릴 의무는 없습니다. 고용주는 귀하가 DACA 프로그램의 수혜자인지 또는 노동 허가서를 어떻게 받았는지에 대해 질문할 권리가 없습니다.
    • 노동 허가가 만료되기 전까지 고용주는 귀하를 해고하거나 업무를 정지 시키거나 업무를 변경할 권리가 없습니다. 고용주는 허가서의 만료일이 가까와지면 노동 허가서의 갱신여부를 귀하에게 물을 수는 있지만  만료일 전까지는 귀하에게 불리한 조치를 취할 수 없습니다. 
  2. 사회 보장 번호 (Social Security Numbers; SSNs)
    • 사회 보장 번호(SSN)는 노동 허가서및 DACA 승인이 만료되더라도 평생 동안 유효합니다.
    • 사회 보장 번호를 아직 신청하지 않았다면 DACA와 노동 허가서가 여전히 유효할 때  신청하도록 하십시요.
    • 노동 허가서가 만료된 후에도 DACA  프로그램을 통해 취득한 사회 보장 번호(SSN)를 계속 사용할 수 있고, 또 사용해야만 합니다.  사회보장번호 (SSN)은 학업, 은행업무, 주거 및 기타 목적를 위해 사용할 수 있습니다.
    • 귀하의 사회 보장 번호에는 이 번호를 취업 목적으로 사용하기 위해서는 유효한 노동 허가서를 필수적 제출해야 한다는 조건이 포함되어 있습니다.     
  3. 운전 면허증
    • 일리노이주의 경우 노동허가증이 만료되는 시점에서 귀하의 운전면허증이 취소될 수도 있습니다. 이런 경우임시 방문자 운전면허증을 신청하세요.
  4. 기타 다른 종류의 이민 방법 
    • 많은 DACA 수혜자들이 노동 허가서나 영주권을 취득할 수 있는 다른 종류의 이민 신청이 가능할 수도 있습니다.

    • 사기성 이민 서비스 제공자를 피하기 위해서는 제공자의 자격 증명서를 확인하고, 서면 계약서를 요청하며, 모든 종류의 지불금에 대한 영수증을 반드시 받아야 합니다.  서비스 제공자에 대해 의심이 생긴다면, 다른 전문가에게 두번째 의견을 구하도록 하십시요.
