The parliamentarian’s recommendation can’t stop us from winning #CitizenshipForAll!

On September 19th 2021, the Senate Parliamentarian, Elizabeth MacDonough, recommended against the inclusion of a pathway to citizenship for millions of immigrants in the budget reconciliation. Though HANA Center is deeply disappointed by this decision, we are firmly committed to holding Congress and the Biden administration accountable to doing their job and passing a pathway to citizenship for immigrants this year.  

The Parliamentarian is an unelected advisor who merely offers recommendations; they do not make laws or legislative decisions. Congress itself holds the real power to make decisions, which can override the Parliamentarian’s opinion, when they vote.

“There is no question that citizenship belongs in the budget under the Byrd Rule. That is why the House Bill included citizenship because citizenship for immigrants would directly impact the federal budget. Our lives are so much more than a budgetary issue, but citizenship for immigrants would greatly boost wages, reduce deficits, increase tax benefits, and strengthen the US economy in many more ways. Congress must be present in real time, away from archaic traditions and precedents, and override the Parliamentarian’s recommendation to ensure a pathway to citizenship is included in the budget reconciliation,” stated Sam Park, HANA Center’s community leader who recently received his DACA renewal after USCIS’ backlog of his and 44,000 other cases caused a lapse in his DACA status.

Gloharn Choi, HANA Center’s Immigrant Justice Organizer stated, ”This is a setback, but I remain hopeful for myself, my family, and my community who have all been waiting so long for a pathway to citizenship. There are other proposals that Congress will take to the Parliamentarian. Congress and the White House have committed to getting a pathway to citizenship for immigrants through the Budget Reconciliation process. Today, HANA Center’s community members are going to Washington D.C. for a national "Welcome Back Congress - March for Citizenship, Care, and Climate” to urge Congress to use their power and deliver on their commitment! We will keep fighting because we know we can win when we organize!”

의회 법학자의 소견은 우리가 시민권을 쟁취해 내는 것을 막을 수 없습니다!

2021년 9월 19일, 연방 상원 의회 법학자 엘리자베스 맥도너가 예산 조정안에 수백만 명의 이민자들을 위한 시민권 취득안을 포함시카는 것을 반대하도록 권고했습니다. 하나센터는 이 결정에 크게 실망했지만, 올해 의회와 바이든 행정부가 그들이 약속한 임무를 수행하고, 이민자 사회 멤버들이 시민권 취득을 할 수 있는 법안을 통과시키는데 책임을 지도록 계속해서 노력해 나아갈 것입니다.   

의회 법학자는 의회에 상정된 법안이나 결정에 대해서 권고안을 제안하는 비선출직입니다. 의회 법학자라는 직책 자체에 법률이나 입법 결정권이 부가된 것이 아니기에 의회가 실질적으로 결정을 내리게 되는 권한자이고, 투표로 법안의 결과가 부쳐질 때 의회 법학자의 의견을 번복하는 것 또한 가능합니다. 

“버드 룰에 따르면 (버드 룰: 예산 조정 법안 심사 때 심사 법안과 무관하다고 생각되는 지출 법안을 끼워 넣지 못하도록 제한하는 규칙) 시민권은 이번 예산에 포함되어야 합니다. 이민자의 시민권 취득 법안이 연방 예산에 직접적인 영향을 미치기 때문에, 하원 의회에서 시민권을 포함한 이유입니다. 물론, 이민자 개개인의 삶은 예산 편성 문제 그 이상이지만, 이민자에게 주어지는 시민권으로 인해, 임금이 크게 올라가고, 적자를 줄이고, 세금 혜택을 증가시키며, 여러 방면으로 미국 경제를 훨씬 더 강화할 수 있습니다. 의회는 구시대적인 통념과 선례에서 벗어나 현재를 바라보고 시민권으로의 길을 예산 조정안에 포함되면 안 된다는 의회 법학자의 소견을 번복해야 합니다.”라고 샘 박 씨가 덧붙였습니다. 최근 다카 갱신이 서류처리가 지연되면서 만료 이후에나 갱신을 받은 하나센터 커뮤니티 멤버 샘과 같이, 약 44,000명의 다카 수혜자들이 아직도 기다리는 중입니다. 

하나센터 이민 정의 조직활동가 최글로한 씨가 이어갔습니다, “(의회 법학자의 결정이) 역행인 것은 사실입니다. 하지만, 제 자신과 가족들, 그리고 시민권으로의 길을 오래도록 기다려온 제 지역 사회 구성원들을 위해 아직 희망적입니다. 의회가 법학자와 이견 조율을 할 수 있는 다른 방안들이 마련되어 있고, 의회와 백악관은 예산 조정 과정을 통해 이민자들이 시민권으로의 길로 향할 수 있도록 약속했습니다. 오늘, 하나센터의 커뮤니티 멤버들은 워싱턴 DC로 이동해 그들의 힘을 사용하고 정부가 약속을 이행할 것을 촉구하기 위해 전국적인 “의회의 복귀를 환영합니다 - 시민권, 보살핌, 기후를 위한 행진”에 참석하게 되었습니다. 우리는 우리가 조직적으로 활동 할 때 이길 수 있다는 것을 알기에, 계속해서 투쟁해 나아갈 것입니다.”
